Function under the National Tariff Commission Act , 1990

The function of the Commission is to advise the Government on:

(i) tariff measures or other form of assistance for:

(a) providing protection to the indigenous industry;

(b) improving the competitiveness of the indigenous industry; or

(ii) any other matter relating to protection or assistance to the indigenous industry that the
Federal Government may refer to the Commission. back to top

Functions under Trade Defense Laws

(i) Anti-Dumping Duties Ordinance, 2000

Under this Ordinance, the Commission processes applications against allegedly dumped imports and imposes antidumping duties on the foreign exporters found to be dumping their products into Pakistan for a period of up to five years in appropriate cases where it establishes after due process:

· that a product has been dumped into Pakistan; and

· the dumping has caused or threatens to cause material injury to Pakistan’s domestic industry.

(ii) Countervailing Duties Ordinance, 2001

Under this Ordinance, the Commission processes applications against allegedly subsidized imports and imposes countervailing duties for a period of up to five years on subsidized good being exported to Pakistan where it establishes after due process:

· that a subsidy exists; and

· the subsidized imports have caused or threatens to cause material injury to Pakistan’s
domestic industry.

(iii) Safeguard Measures Ordinance, 2002

Under this Ordinance, the Commission processes applications and makes recommendations to the Federal Government for imposition of safeguard measures (being chiefly tariffs on the product in question), if it establishes after due process:

· that there has been a sudden and unforeseen surge in imports of the product in question; and

· Pakistan’s domestic industry has or is threatened with serious injury.
